Son of sugar baron Ratnakar Gutte and director of the film, The Accidental Prime Minister, Vijay Ratnakar Gutte has been arrested by the Directorate General of Goods and Services Tax Intelligence (DGGSTI) for alleged Goods and Services Tax (GST) evasion worth Rs. 34 crore.
A Mumbai court has sent Vijay Gutte to judicial custody in the Arthur Road jail till August 14.
It may be recalled that Vijay’s father, Ratnakar Gutte, contested the MLA elections but lost in the 2014 assembly polls.
Curiously Vijay Gutte’s father is also facing allegations of cheating and bank frauds worth Rs 5,500 crore. Dhananjay Munde, the Leader of the Opposition in the Legislative Council has alleged that Ratnakar Gutte has floated some 22 bogus companies to swindle over 26,000 farmers and banks. According to Munde although several cases of cheating and fraud worth over Rs 5,500 crore have surfaced against the elder Gutte’s firms, the Maharashtra government is shying away from arresting him.
According to Munde, Ratnakar Gutte’s sugar unit took loans in the names of over 600 farmers under the ‘harvest and transport’ scheme in 2015 and has been using the vehicles procured in the farmers’ names in the sugar factory without repaying the loan. As a result banks are now pestering the ignorant farmers to repay the outstanding loan amounts.
In the present context, Vijay Gutte’s firm, VRG Digital Corp had sought a refund of Rs 28 crore from the government towards CENVAT (Central Value Added Tax) based on fake invoices.
Accordingly Vijay Gutte has been booked under Section 132 (1)(c) of CGST Act, for “wrongful availment” of input tax credit using bills and invoices– without any supply of goods or services.
As per law, anyone found to be evading tax or wrongfully seeking a refund of over Rs 5 crore, is likely to be fined and imprisoned for up to five years.
According to sources Vijay Gutte’s firm VRG Digital Corp Pvt Ltd, walked into the trap when it obtained the “fake invoices” for animation and manpower services from — Horizon Outsource Solutions Pvt Ltd and Best Computer Solutions Pvt Ltd and tried to defraud the state exchequer by claiming refund on the basis of the bogus invoices.
Meanwhile the Directors of the two Mumbai-based firms — Horizon Outsource Solutions Pvt Ltd and Best Computer Solutions Pvt Ltd — have already been arrested in connection with alleged service tax and GST fraud worth Rs 173 crore.
DGGSTI’s investigations revealed that Horizon Outsource Solutions Pvt Ltd obtained false invoices from Best Computer Solutions Pvt Ltd to hoodwink the government and claim GST credit of Rs 80 crore for baseless and non-existent software services which were never provided. Based on such fraudulent financial manipulations Horizon Outsource Solutions Pvt Ltd went on to issue bogus invoices to its preferred clients like Vijay Gutte’s VRG Digital Corp even without any actual supply of goods or services.
Vijay Gutte has so far produced three films, Emotional Attyachar, Time Bara Vait and Badmashiyaan. His directorial debut film ‘The Accidental Prime Minister’ is based on former media advisor to the Prime Minister Dr Sanjaya Baru’s book. It features Anupam Kher as Prime Minister Manmohan Singh and German actress Suzanne Bernert as Sonia Gandhi besides Aashana Kumra as Priyanka and Arjun Mathur as Rahul Gandhi.
Akshaye Khanna plays the part of the PM’s media advisor, Baru in the film which is slated for release on 21 December 2018.
